Overview
These Terms & Conditions set out how the Handpicked Preloved Limited selling service operates and form the agreement between Handpicked Preloved Limited (“Handpicked”, “we”, “us” or “our”) and all sellers using our service (“seller”, “you” or “your”). These Terms explain the responsibilities of both Handpicked and the seller, including how items are accepted, priced, displayed, sold, returned, paid out and collected.
Our current Terms & Conditions are always available on our website and may be updated from time to time without prior notice. By leaving items with us for sale, you confirm that you have read, understood and agreed to the most recent version of these Terms & Conditions.
If you do not agree to these Terms & Conditions, you must notify us in writing within 24 hours of leaving your items with us. After this time, we will continue with the preparation, processing and sale of your items in accordance with these Terms.
1. Seller Eligibility
1.1 Sellers must be aged 18 years or over.
1.2 We reserve the right to request valid photographic identification when setting up a seller account or at any stage during the selling process.
1.3 By submitting items for sale, you confirm that:
• the items belong to you or you have full legal authority to sell them;
• the items are authentic and not counterfeit;
• all information provided to us is accurate and complete.
2. Contact Information
2.1 It is your responsibility to provide accurate and up to date contact information, including your email address and telephone number.
2.2 You are responsible for checking your email communications regularly, including junk and spam folders. We recommend adding our email address to your contacts to avoid missed communication.
2.3 Handpicked Preloved Limited cannot be held responsible for missed communications resulting from incorrect contact details, spam filtering or emails not being read by the seller.
3. Consignment Service
3.1 Handpicked Preloved Limited acts as a selling agent on your behalf. Items remain your property until sold to a customer or otherwise disposed of in accordance with these Terms.
3.2 We do not purchase items directly from sellers unless agreed separately in writing.
3.3 Submission of items does not guarantee acceptance, listing or sale.
4. Acceptance of Items
4.1 All items must meet the acceptance criteria outlined on our website and social media platforms.
4.2 We reserve the right to refuse, remove, return or withdraw any item from sale at any stage and for any reason, including where items:
• are unsuitable for our customer base;
• are damaged, marked or excessively worn;
• develop odours, mould or deterioration;
• are suspected to be counterfeit;
• no longer fit seasonal or business requirements.
4.3 We reserve the right to lightly steam, lint roll, de bobble, clean, style or prepare items for photography and sale where necessary.
5. Item Preparation & Cleaning
5.1 Items should be provided in clean, fresh and sale ready condition.
5.2 Where items require additional preparation in order to be suitable for sale, including steaming, lint rolling, de bobbling, odour treatment, stain removal or cleaning, Handpicked Preloved Limited reserves the right to carry out this work in house and apply a reasonable preparation or cleaning charge.
5.3 Any applicable charges may be deducted from the final payout.
6. Pricing & Reductions
6.1 All pricing decisions are made solely by Handpicked Preloved Limited using our in house pricing guidelines, market research and experience.
6.2 Pricing is not negotiated with sellers, except for individual items valued by us at over £500.
6.3 We reserve the right to reduce prices, run promotions, negotiate with buyers and apply markdowns at our discretion throughout the selling period.
6.4 Final reductions of up to 50% may be applied where items are not generating sufficient interest or are approaching the end of their selling period.
6.5 Commission is calculated on the final selling price after any reductions or promotions.
6.6 If a seller disputes pricing or refuses agreed markdown procedures, we reserve the right to terminate the selling agreement and request collection of the items.
7. Commission
7.1 Standard commission is 50% of the final selling price for clothing, shoes and accessories.
7.2 Commission rates for high value items may differ and will be confirmed separately in writing before sale.
8. Selling Platforms
8.1 Items may be sold through our physical store, website, social media channels or approved third party selling platforms.
8.2 The choice of selling platform is entirely at our discretion and items may not appear on every platform.
9. Sale Period
9.1 Standard selling periods are up to 90 days unless otherwise agreed in writing.
9.2 We reserve the right to extend the selling period where items remain suitable for upcoming seasons or continued sale opportunities.
10. Sale Notifications & Returns
10.1 We will notify you when an item has sold.
10.2 A sale is not considered final until the applicable returns period has passed.
10.3 In line with distance selling regulations, online purchases may be returned within 30 days of delivery.
10.4 Returned items may automatically be placed back on sale without further notification to the seller.
10.5 We reserve the right to extend the selling period following a return to allow additional time to achieve a resale.
11. Payments
11.1 Payments are processed on the 15th of each month for items that have completed the full 30 day returns period.
11.2 For example:
• an item sold on 1st May would normally be included in the 15th June payout;
• an item sold on 20th May would remain within the returns period and would therefore be included in the 15th July payout.
11.3 Payments may be made via:
• cash;
• BACS transfer;
• store credit;
• charity donation.
11.4 It is the seller’s responsibility to provide accurate payment details and notify us promptly of any changes.
11.5 Bank details provided must match the seller’s name.
11.6 Where payment is requested into an account not matching the seller’s name, we reserve the right to request:
• valid photographic ID for the seller;
• valid photographic ID for the account holder;
• a valid bank card for the receiving account.
11.7 These checks must be completed in person before payment can be released.
12. Authentication & Counterfeit Goods
12.1 Items may be authenticated in house or through a trusted third party authentication provider.
12.2 Authentication fees may be charged to the seller where an item is found to be counterfeit or cannot be authenticated due to insufficient supporting information.
12.3 We reserve the right to refuse, retain or report counterfeit goods to Trading Standards, brands, law enforcement or other relevant authorities where appropriate.
12.4 If we are unable to authenticate an item, we will contact you to arrange collection.
13. Exclusive Selling Agreement
13.1 While items are listed with Handpicked Preloved Limited, sellers must not advertise, list or sell the same items elsewhere.
13.2 Dual listing may result in immediate removal from sale, suspension of the seller account or termination of the agreement.
14. Photography & Intellectual Property
14.1 All photographs, styling, branding, written descriptions and listing content created by Handpicked Preloved Limited remain our intellectual property.
14.2 These materials must not be copied, reproduced or used without our written permission.
14.3 Unauthorised use of our photography or listing content may result in charges or legal action.
15. Item Withdrawal
15.1 If you wish to withdraw an item from sale during the agreed selling period, you must notify us in writing and receive confirmation from our team before arranging collection.
15.2 Items cannot be removed directly from the shop floor during walk in visits or without prior authorisation.
15.3 This process is necessary to allow time for stock checks, delisting, payment verification and order processing, as items may already be sold, reserved, packed for dispatch or awaiting payout.
15.4 Unauthorised removal of items may be treated as theft and we reserve the right to take appropriate action where necessary.
16. Collections & Unclaimed Items
16.1 At the end of the agreed selling period, it is the seller’s responsibility to contact us to arrange collection or confirm donation of unsold items.
16.2 While we do our best to contact sellers, we cannot guarantee delivery of emails or messages. Sellers remain responsible for monitoring communication and arranging timely collection.
16.3 All collections are strictly by appointment only. A booking link will be provided where appropriate. Walk in collections are not available.
16.4 If another person will be collecting items on your behalf, this must be confirmed by you in writing before the appointment.
16.5 Unsold items must be collected within 30 days of the end of the selling period unless otherwise agreed in writing.
16.6 Due to limited storage space, we reserve the right to apply storage charges for items not collected within the agreed timeframe.
16.7 Any items not collected within 30 days, and where no alternative arrangement has been agreed in writing, will be considered abandoned. We reserve the right to donate, recycle, dispose of or otherwise deal with these items at our discretion.
17. Donations
17.1 Sellers may request that unsold items are donated rather than collected.
17.2 Donations will be made to a charity partner selected by Handpicked Preloved Limited.
17.3 We reserve the right to change charity partners at our discretion and may not notify sellers once donations have been completed.
18. Ownership, Insurance & Risk
18.1 Ownership of items remains with the seller until the item is sold to a customer.
18.2 Handpicked Preloved Limited maintains appropriate business insurance and takes every reasonable care with items left in our possession.
18.3 However, all items are accepted and stored at the owner’s risk and we cannot guarantee compensation for every circumstance, including accidental damage, deterioration, theft or events outside our reasonable control.
18.4 To the fullest extent permitted by law, Handpicked Preloved Limited cannot be held responsible for:
• theft;
• accidental damage;
• fading;
• deterioration;
• wear;
• mould;
• odour changes;
• force majeure events;
• or other issues outside our reasonable control.
18.5 Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability which cannot legally be excluded under the laws of England & Wales.
19. Limitation of Liability
19.1 Handpicked Preloved Limited does not guarantee:
• that any item will sell;
• that items will achieve a particular price;
• or that items will sell within a particular timeframe.
19.2 Our total liability in relation to any claim shall not exceed the agreed payout value of the item concerned.
20. Changes to Terms
20.1 We reserve the right to amend these Terms & Conditions at any time.
20.2 The latest version will always be available on our website. Continued use of our service following updates constitutes acceptance of any revised Terms.
21. Severability
21.1 If any provision within these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22. Governing Law
22.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England & Wales.
22.2 Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England & Wales.
